Licence agreements

I've recently developed a series of (copyrighted) handbooks that I use to back up some ultra-short courses (2.5hours) I run.

One participant is interested in having one of these for use with their organisation's own students.

I think a licence agreement or right to reproduce agreement is probably the way to go - but I've never done this before and have no idea what to charge. - Any ideas?

    Hi Cathy,

    The amount you should charge is relative to the added value that the handbook to its user in comparison to other books/handbooks/documents that might offer your participant an alternative source of information. You will also need to bear in mind recovery of any production costs associated with providing copies of the handbooks: are you providing them in electronic format (i.e. PDF) or in hardcopy? If electronic format, what actions can you take to prevent editing or unauthorised reproduction? Is it a one-off requirement for a single participant or could this become a new long-term revenue stream for you?

    Also, if you plan to have a license agreement and have not done this before, what wording will you put in the agreement?

    It is difficult to put in all the safety features to avoid plagerism … and then police it! How many of us have used the texts of others to create our own courses?

    It comes down to trust and a relationship. Brefi Group work with authors in accrediting and marketing their materials on a royalty per use basis. The other model is to sell the rights to reproduction and usage outright for an agreed sum. The negotiation that ensues is probably the best price regulator … what the client sees as good value and what you are prepared to release the material for.
