Hello everyone,
I am interested to know how trainers who are paid to design and develop a training programme/materials for a division of a company, deal with requests for that same training material from a second division within the company. We are facing a recent situation where the programme is developed and now other divisions are 'showing up' saying they would like the programme too and feel that as it is already developed there should be no further costs.
How do others handle this situation? Do you have an agreement saying only the first division is able to use the material as it was developed for them or do you have a licensing system?
I am interested to hear from anyone who has 'licensed' materials they have developed for a company.

…what constitutes a "division"
and
…what your contract is regarding ownership of the intellectual property

…what your company will get out of the continued delivery

…what your relationship is like
My approach is that if I am going to continue to earn through delivery, and there is no further development to do, I'll be happy to continue to provide a service and get a fair day's pay.

My feedback would be:
1. If you are not designing a course why would you charge someone for that existing material? If you have designed a generic course to offer to other 'divisions' then how you choose to charge that is determined by how much they are prepared to pay. BUT
2. You should clarify who 'owns' the material you designed? I have met trainers who are asked and paid to create a bespoke program for a company and then expect they can use that again. No, the company have paid for your time and input and the intellectual property belongs to them.

The division is actually a country and we are having a meeting tomorrow to finalise contracts etc so I was interested to hear other people's thoughts. We are designing and piloting for a region of four countries (who are paying for it) It is not existing material and based around a very specific need for that region. We already know other countries outside the region are interested so I am testing the water as to how best to approach this. Once development is complete we will train regional and country master trainers who will deliver internally (in three different languages to up to 4,000 people).
