Cancellation Fees Part Deux

You may have read my posting last week about a late cancellation of a course because of the snow.  My client (the training provider) decided they would not charge a cancellation fee to their client (a charity) as the course was to be rearranged, so I ended up with no cancellation fee either.

Fast forward to today when I learn that the first date the course can take place is end April (3 months away) which I can't do as I am likely to be recovering from an op then.  Two other possible dates are at the end of June which should be OK but if my op is delayed they may be iffy.  I have said I will take either of the June dates and keep fingers crossed. I would know well in advance if I can't do them.  However, training provider co has now said that they will get another trainer to do the course as the client really wants it done in April.  So, I have done a couple of days' course development and prep and will end up with no recompense whatsoever! Am I right to be hacked off by this? My argument to them today is that flexibility works both ways.  The training provider wants to be flexible with the end client but it seems neither my client or their client can be flexible with my availability! I await a call back!

Would be grateful for others' views on this new development.

    This sort of situation is not that uncommon. The basic issue is often the lack of an agree contract. Do you have one with the company?

    Some thoughts:

    What are your terms in instances like this: did you declare these to the training company first?

    If you have not got your terms in place; have you agreed to the companies terms?

    What were the arrangements regarding development: do you have any restrictions on the use of the materials? If you wrote the material you may have copyright protection.

    Always endeavour to get your terms into the negotiation first: have them on your web site and send to the prospective client at the earliest convenience?
