One Response

  1. Unfair Dismissal
You usually have to have been with your employer for at least one year. However, if you are dismissed for being pregnant or related reasons or dismissed for being a member of a trade union or related activities, then there is no time limit. The onus is on the employer to show that the dismissal was fair (a) that it was for an acceptable reason e.g. the employee is unable to do their job and (b) that they acted reasonably in dismissing the employee. The DTI issues a useful helpsheet setting out the relevant law and procedures : see http://www.dti.gov.uk/access/dismiss.htm
